PFAS Statement

Beginning January 1, 2026, pesticide registrants must annually provide a statement to the MDA indicating whether a product contains intentionally added PFAS. Manufacturers, guarantors, and licensees will see new fields on their renewal forms beginning in 2026 to address PFAS reporting requirements. For those registering individual products, there will be a field next to each product to indicate whether the product contains intentionally added PFAS (“yes” or “no”).

Reporting Requirements

Beginning January 1, 2026, manufacturers must annually provide additional information for fertilizer, specialty fertilizer, soil amendment, plant amendment, and agricultural liming products that contain intentionally added PFAS including:

  • The name and purpose for each PFAS in the product, including any product components;
  • The amount of each PFAS in the product identified by its name, chemical structure, chemical abstracts service registry number, or other unique method approved by the commissioner, for each PFAS;
  • Or any other information required by the commissioner.

A reporting form will be made available soon through which manufacturers can submit this required information. Reporting forms must be submitted by the end of 2026 for all products containing intentionally added PFAS.

Extensions for submission of the required material will be determined on a case-by-case basis by the commissioner, if requested.

Data

The data submitted is public under Minnesota law unless it qualifies for protection under the Protection of Trade Secrets law (MINN. STAT. § 18C.405) or other applicable state or federal law. For data to meet the requirements for protection under this law (MINN. STAT. § 18C.405), registrants are required to clearly mark on the form or other submitted materials any data they believe qualify as a trade secret, commercial data, or financial data. Note that merely marking submitted data as a trade secret, commercial data, or financial data is not sufficient to have the data be classified as not public data; the Commissioner of Agriculture ultimately makes the final determination on if the data qualify for such protection.
